BOSTON, MASSACHUSETTS - Armslist LLC announced that it has successfully defended itself against a Brady backed lawsuit. Brady was established in 1980 as Handgun Control Inc.
In Stokinger v. Armslist, Brady argued before the Massachusetts Superior Court that the Safe Harbor of the Federal Communications Decency Act, 47 USC. 230, does not apply to the Armslist.com website because the website permits users to search and filter third party classified listings, such as by product make, model, item location, and seller type (i.e., dealer or private party). The court disagreed with Brady and ruled that the CDA 230 Safe Harbor applies to the website because Armslist does not create the third party classified listings, nor is Armslist directly involved in the transaction. The court cited and followed the recent Wisconsin Supreme Court and United States Court of Appeals for the Seventh Circuit decisions, in which Armslist prevailed against Brady on the same issue.
“We defended the foundation of the Internet against another assault, aimed at destroying free speech on the Internet,” Jon Gibbon, of Armslist said. “We fought against Brady’s bullying tactics. For almost 50 years, Brady has tried to chill constitutionally protected rights by attempting to bankrupt prominent parties who operate within constitutionally protected industries that Brady does not approve of. Brady obviously does not care if their anti-constitutional cause results in the destruction of the Internet. ”
The Electronic Frontier Foundation has recognized CDA 230 as the most important law protecting Internet speech. Armslist views the continued assault on CDA 230 by Brady as a severe threat to the Internet and the US economy. The success of Brady would jeopardize the continued operation of allInternet Service Providers and any online service that permits end-users to post content, and to search and filter third-party content. Other sites that would be affected included Facebook Marketplace, Craigslist, Autotrader, Yelp, eBay, and Etsy.
Armslist has prevailed in every jurisdiction where Brady has filed suit, including the United States Supreme Court, United States Court of Appeals for the Seventh Circuit, Wisconsin Supreme Court, and Massachusetts Superior Court.
Brady recently filed another lawsuit against Armslist in Federal Court in the Eastern District of Wisconsin, putting forth the same arguments used in Stokingerand once again threatening free speech on the Internet.

I can't stand the continuous video add playing; it neverchanges and is annoying and distracting. I used to put up with it for the free account. I am not going to pay for a subscription to ask questions, see prices and have that stupid video add getting in the way and playing in my eyes everytime I go to a new page or move my mouse pointer in armslist. The quality and quantity of firearms for sale has tanked since a few years ago.

I personally don't have a problem paying for usage of Armslist, even though I'm just a casual hobbyist, but there's been a HUGE drop off in listings lately, as well as interest in my own listings. It's a bit frustrating actually. I loved the simplicity of this platform. But now I'm being pushed to look elsewhere.

If they keep this up, and I think we all know that they will, then Armslist should consider a countersuit for legal costs and damages. Due to the number of times that the petitioners have been smacked down in court over their use of the same arguments, any successive litigation should be considered frivolous in nature, and should be sanctioned and punished appropriately.

I've used Armslist for years and still do! I happily subscribed as it is a very small price to pay towards the mutually beneficial contribution of defending the 2nd amendment. What many, ignorant commentators, unequivocally fail to recognize, is that this: The legal attack against Armslist is unknown to majority and not in headlines anywhere. This is the Anti Gunners deliberate, methodical and Machiavellian driven process, where by starting their assault where no one is looking, they gain victory through deceit or simply gambling for one judge to agree with their side. One ruling in Brady's favor would trigger Brady to claim precedent, and immediately take aim at Gunbroker, GunsAmerica, Gunwatcher.com and ANY AND ALL WEBSITES THAT PROVIDE us means of exercising both our 1st and 2nd amendment rights. For those that don't agree with what Armslist has done with its subscription, go to another site. They did not ask for the innumerable legal challenges, battles and costs associated with defending themselves. Again, adds will only bring in so much revenue to help sustainment, but moreover, legal fees have the ability to reach 10's to 100's of thousands worth in a simply matter of months. I come here occasionally and do a Nationwide search by clicking the magnifier and filtering the premium venders. I have found that you have already lost well over a third of your ads and the ad count drops daily. It's like watching a snowman melt until its gone. What separates good businessmen from the bad is realizing a mistake and correcting it. People aren't going to pay to ask questions or make offers that may not be accepted. People also are not likely to want to be on a list of transactions tied to their banking accounts in this political climate. I wish you luck in finding a profitable way to run the site without running it under.

I’ve bought alot of stuff off of Armslist over the last few years, but now that it is subscription-based I guess I’ll have to stop using it altogther. The ads were annoying but tolerable for a free site, to be honest I ignored 99% of them, however I knew they were a source of revenue needed to operate the site in a profitable manner. I used to check daily for deals so in a sense the anti-gunners got their way, I’m going to limit what I now spend on a bi-weekly basis and check the local gun stores more often. If you ever get back to a free-of-subscription model I’ll go back to using the website on a continuous basis. Thanks.
